The Association has begun taking ads for inclusion in

We offer this update not because the situation is moving
closer to resolution, but because we have not provided
an update for several months.
|
|
Both the Zuni and Navajo Tribes have filed motions
indicating their desire to represent themselves rather
than being represented by the Federal Government.
|
|
Pursuant to an order by the Special Master, the Federal
Government and the State have each proposed how to
proceed, and there is no agreement between them. The
Federal Government suggests dismissing the case as to
non-governmental defendants, undertaking a
hydrographic survey of parts of the area, and then
bringing into the suit again those defendants whose
water rights are found and offering them a settlement
that would define their rights. The State of New Mexico
stated that they have no funds to perform a hydrographic
study, and proposed that the stay be lifted and the court
move forward with the legal proceedings to resolve the
suit.

A flurry of motions and answers to these two proposals
has been filed by a variety of parties, and the stay
continues.
|

We understand that one group, the Western New Mexico
Water Preservation Association, has recently sent out
letters soliciting membership. Although this is an
authentic organization working to represent individual
landowners in the lawsuit, because we believe that either
the lawsuit will drag on for decades or the State water
allocation process as described above will eventually run,
or both, we do not endorse or oppose this or any other
group. Our conclusion that there is a very low probability
that this suit will in any way affect the right of individual
landowners to establish or use domestic wells remains
